Kerala High Court today ruled that a degree acquired through distance education of a university cannot be considered inferior to a degree from a regular course in a college.
An Asst Chemical Examiner in the state service had applied for the promotion post of joint chemical examiner. The authorities held that her MSc degree from Madurai Kamaraj university through distance education in inferior to that of a regular college course and technically it cannot be considered.
A division bench however rejected the government stand and said that as per the existing rules qualification is Msc with 50 per cent mark only and that rules do not discriminate between regular degree and that acquired through distance education.
However the government is free to change the qualification prescription through appropriate amendment of the rules, if so desired. As rules stand now, degree through distance education is also a prescribed qualification.
