The Chief Judicial Magistrate Court here Friday issued an arrest warrant against suspended IPS officer Tomin J. Thachenkary for failing to appear before the court for trial in a custodial torture case.
The incident that triggered the case occurred in February, 1991 when Thachankary was the ASP at Alappuzha. Prakashan of Punnapra was arrested after Suja, the wife of one of his neighbours Rajendra Prasad of Puthenvalappil, was found dead.
Thachenkary had taken Prakashan to custody and allegedly tortured him. Later a Crime Branch probe found Prakashan innocent and that thee case was fabricated.
Prakashan had filed a case against Thachenkary in the Supreme Court alleging that the death of a person was turned into murder by the police officer with ulterior motives. He had also filed petitions against seven other policemen in the High Court in the case.
Based on this the court had asked Thachenkary to be present at the court. He did not obey the court directive after which the court issued arrest warrant. Other accused were present themselves at the court.
